Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the games, applications, websites, and related services (collectively, the "Service") provided by XZ Automation Ltd trading as Fungamelabs ("Fungamelabs", "we", "us", or "our").

Downloading, installing, accessing, launching, or playing any Fungamelabs game is deemed your full and unconditional acceptance of these Terms and our Privacy Policy. You do not need to sign anything or tick a box — the act of playing one of our games is, by itself, your agreement to be bound by these Terms.

If you do not agree to any part of these Terms, do not download, install, or play our games.

Eligibility. You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

License. Subject to your compliance with these Terms, Fungamelabs grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial entertainment purposes only.

Display names. If a game allows you to choose a display name or submit a leaderboard entry, you are solely responsible for it. You must not choose names that are offensive, infringing, impersonating, or otherwise unlawful.

Prohibited conduct. You agree not to: (a) cheat, exploit bugs, or use bots, scripts, or any automated means to interact with the Service; (b) reverse engineer, decompile, or attempt to extract the source code of any game; (c) interfere with, disrupt, or compromise the integrity or security of the Service; (d) use the Service for any unlawful purpose or to harass, abuse, or harm others; or (e) attempt to gain unauthorised access to any portion of the Service or any data within it.

The Service and all content within it — including without limitation software, code, graphics, artwork, characters, audio, music, text, names, logos, trademarks, and other intellectual property (the "Materials") — are owned by or licensed to XZ Automation Ltd trading as Fungamelabs and are protected by copyright, trademark, and other laws.

Except for the limited licence granted to you in these Terms, no right, title, or interest in the Materials is transferred to you. All rights not expressly granted are reserved by Fungamelabs.

Any content you submit through the Service, including display names and leaderboard entries ("User Content"), remains your responsibility. By submitting User Content, you grant Fungamelabs a worldwide, royalty-free, perpetual, non-exclusive licence to host, store, display, reproduce, and distribute that content as part of operating the Service.

Fungamelabs may, at its sole discretion and without notice, remove, modify, or refuse to display any User Content that we consider to violate these Terms or to be otherwise objectionable.

Fungamelabs does not collect personal data from players. We do not track customer metrics, we do not run analytics on player behaviour, we do not use advertising identifiers, and we do not profile our users in any way.

The only piece of information we ever collect is a generic display name that the player manually types in themselves when choosing to submit a score to a leaderboard. That manual entry is the player's explicit and active consent to display the chosen name on the public leaderboard within the game.

Players are free to choose any non-identifying name and are under no obligation to use their real name or any information that could identify them. If a player does not wish to share a name, they simply do not submit a leaderboard entry.

Fungamelabs games are provided free of charge. The Service does not contain advertising or in-app purchases. If we ever introduce paid features in the future, additional terms will be presented to you for acceptance before any charge is made.

Fungamelabs may, at any time and at its sole discretion, modify, update, suspend, limit, or discontinue any part of the Service — including individual games, features, or leaderboards — with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

You acknowledge that the Service is provided on a best-effort basis and may be unavailable from time to time due to maintenance, technical issues, or factors outside our control.

The Service and all content within it are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, XZ Automation Ltd trading as Fungamelabs disclaims all warranties, including without limitation implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation.

Fungamelabs makes no warranty that the Service will meet your requirements, be compatible with your device, or that any defects will be corrected. Your use of the Service is entirely at your own risk.

To the fullest extent permitted by applicable law, in no event will XZ Automation Ltd trading as Fungamelabs, its directors, officers, employees, agents, or licensors be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages — including without limitation loss of data, loss of progress, loss of scores or leaderboard position, loss of profits, loss of goodwill, device damage, or any other loss — arising out of or in connection with your use of, or inability to use, the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not we have been advised of the possibility of such damages.

To the extent liability cannot be excluded by law, the total aggregate liability of XZ Automation Ltd trading as Fungamelabs arising out of or related to these Terms or the Service is limited to the greater of (a) the amount you paid to Fungamelabs in the twelve months preceding the claim, or (b) five pounds sterling (£5). Because the Service is provided free of charge, this amount will typically be zero.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence or for fraud.

You agree to defend, indemnify, and hold harmless XZ Automation Ltd trading as Fungamelabs, its directors, officers, employees, and agents from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (i) your use of the Service; (ii) your breach of these Terms; (iii) your User Content; or (iv) your violation of any law or the rights of any third party.

These Terms and any dispute arising out of or in connection with them or the Service are governed by the laws of England and Wales, without regard to conflict of laws principles. You agree to submit to the exclusive jurisdiction of the courts of England and Wales for the resolution of any such dispute, except where prohibited by applicable mandatory consumer protection law.

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be modified or severed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Fungamelabs may revise these Terms from time to time. Updated Terms will be posted within the game, application, or on the Fungamelabs website, with a new "Last Updated" date. Your continued use of the Service after any such update is deemed your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
