Terms of Use

Welcome to Fungamelabs. Each time you use any Fungamelabs game or application, you agree to be bound by the following Terms of Use and the Privacy Policy. If you do not agree to any of these terms, then you must immediately discontinue your use of Fungamelabs services.

These Terms of Use apply to all customers, visitors, users, and others who access or use Fungamelabs games and applications ("Users"), including Users who contribute content such as leaderboard entries, display names, and other materials.

Fungamelabs services may contain links to third-party websites that are not owned or controlled by Fungamelabs. Fungamelabs has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites. By using Fungamelabs services, you expressly relieve Fungamelabs from any and all liability arising from your use of any third-party website.

We encourage you to be aware when you leave Fungamelabs services and to read the terms and privacy policy of each other website that you visit.

A. Fungamelabs hereby grants you permission to use its games and applications as set forth in these Terms of Use, provided that: (i) your use is solely for your personal, noncommercial use; (ii) you will not copy or distribute any part of the games or applications in any medium without Fungamelabs's prior written authorization; (iii) you will not alter or modify any part of the games or applications other than as may be reasonably necessary to use them for their intended purpose; and (iv) you will otherwise comply with the terms and conditions of these Terms of Use.

B. In order to access some features of Fungamelabs services, you may have to create an account or provide a display name. You may never use another's account without permission. When creating your account or display name, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify Fungamelabs immediately of any breach of security or unauthorized use of your account.

C. You agree not to use or launch any automated system, including without limitation, "robots," "spiders," "offline readers," etc., that accessesFungamelabs services in a manner that sends more request messages to our servers in a given period of time than a human can reasonably produce in the same period by using a conventional online connection. Fungamelabs reserves the right to revoke these exceptions either generally or in specific cases. You agree not to collect or harvest any personally identifiable information from Fungamelabs services, nor to use the communication systems provided by Fungamelabs for any commercial solicitation purposes.

D. Fungamelabs may permanently or temporarily terminate, suspend, or otherwise refuse to permit your access to its services without notice and liability, if, in Fungamelabs's sole determination, you violate any of these terms, including the following prohibited actions: (i) use Fungamelabs services for any illegal purpose or to submit, transmit or facilitate the distribution of information or content that is unlawful, harmful, abusive, racially or ethnically offensive, vulgar, obscene, sexually explicit, defamatory, infringing, invasive of personal privacy or publicity rights, harassing, libelous, threatening, or in a reasonable person's view, objectionable; (ii) submit, transmit, promote or distribute information or content that is illegal; (iii) attempt to interfere with, compromise the system integrity or security or decipher any transmissions to or from the servers running Fungamelabs services.

The content on Fungamelabs games and applications, including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like ("Content") and the trademarks, service marks and logos contained therein ("Marks"), are (a) owned by, (b) licensed to, or (c) used in accordance with fair use principles by Fungamelabs, subject to copyright and other intellectual property rights under United States and foreign laws and international conventions. Content on Fungamelabs services is provided to you AS IS for your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners.

YOU AGREE THAT YOUR USE OF FUNGAMELABS SERVICES SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, FUNGAMELABS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF. FUNGAMELABSMAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE CONTENT OR THE CONTENT OF ANY SITES LINKED TO THE SERVICES AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SERVICES, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES, (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE SERVICES BY ANY THIRD PARTY, AND/OR (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES.

IN NO EVENT SHALL FUNGAMELABS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SERVICES, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES, (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH THE SERVICES BY ANY THIRD PARTY, AND/OR (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

You agree to defend, indemnify and hold harmless Fungamelabs, its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to Fungamelabsservices; (ii) your violation of any term of these Terms of Use; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Submissions caused damage to a third party. This defense and indemnification obligation will survive these Terms of Use and your use of Fungamelabs services.

By your use of Fungamelabs services, you affirm that you are either at least 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Use, and to abide by and comply with these Terms of Use. In any case, you affirm that you are over the age of 13, as Fungamelabs services are not intended for children under 13. If you are under 13 years of age, then please do not use Fungamelabs services.

These Terms of Use, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Fungamelabs without restriction.

These Terms of Use may be updated from time to time. Any updates will be posted within the game, application, or on the Fungamelabs website. Your continued use ofFungamelabs services after any such changes constitutes your acceptance of the new Terms of Use.
